Definition

Product that departs from its intended design even though all care was exercised. Product differs from manufacturer's specifications or other identical products. Strict liability without proof of negligence. Plaintiff proves product defective, defect existed when left defendant's control, and defect caused injury. No need to prove how defect occurred.
